Linkware & Graphics Terms of Use
The purchase of any linkware/graphics set or linkware/graphics use-license from Firecat Studios indicates acceptance of the following legally binding agreement:
a. protection of copyright
- The artist, Cheryl Donovan, retains full copyright to designs,
layouts, graphics, and images. Misrepresentation of creator is
expressly prohibited.
- You may not alter, change, colorize, resize or modify any
or all images without specifically indicated approval with the
sole exception of adding text to any supplied blank button or
image designed for this purpose. You may not use any of the graphics
or images to create filters, brushes, tubes, nozzles, fonts or
other current/future software plugins.
- You may not alter the set layout except to add your own content.
- Images are not to be placed in any online collection or archive,
or otherwise offered for download; in addition, no images are
to be redistributed for financial gain or placed within any compilation
CD, software or other reproducible media.
- Depending on which use-license you choose, a linkback to
Firecat Studios may be required on every page that graphics
appear. Firecat Studios retain all copyrights and graphics may not be altered (with the exception of adding text to any supplied blank button).

- If you don't want to link back to me, please purchase Exclusive
Rights. With Exclusive Rights, your designware set doesn't have
any copyright restrictions: You can do what you want with the
set and no link back to me is required. Graphics may be altered
and resold.
- With Exclusive Rights, The set will be removed when payment
is received so that it will be not available to others.
b. limitations on use of graphics
- Any site whose intent is to earn revenue is considered a
commercial endeavor. If you are a commercial endeavor and requires
the purchase a commercial use license to use these graphics.
- If use-license is for Personal or Non-Profit website, images
may NOT be used by individuals whose intent is developing web
sites for others and for gain (whether actual income and/or bartered
for trade) whether from the site itself or from the web page
developing service. Use of my images by individuals developing
websites with intent to gain is unequivocally denied unless a
separate license and written permission from me have been obtained
PRIOR to the downloading, uploading or use of any graphic.
- If use license is for Personal or Non-Profit website, you
may not use my graphics if you are developing websites for others
at no charge and then advertise these sites within a client portfolio with intent to acquire
additional paying clients.
- Graphics are licensed for web use only. Please refrain from
using the images in print or other media.
- You are licensed to use the graphics on one web site or domain
only.
- Graphics may not be used within pages promoting child abuse,
hate, bigotry, racism, animal abuse and/or illegal pornographic
activities.
- Licenses to web graphics may not be resold for profit.
c. limitation of liability
- Firecat Studios and Cheryl Donovan disclaim
any warranty, express or implied, for the graphics. Graphics
are provided "as is" and are not guaranteed to be fit
for any particular purpose. Use the graphics at your own risk.
- You agree to indemnify and hold harmless Firecat Studios and Cheryl Donovan from any and all damages arising from the use of these graphics, including but not limited to
loss of business or loss of computer functionality. Under no
circumstances will Firecat Studios and Cheryl
Donovan be held liable for damages even if negligence on our
part can be proven.
d. violation of terms and conditions
- If you are found to be in violation of the above terms and
conditions, you will have 72 hours to remove any and all of my
graphics and/or code from your web site. You will not be issued
a refund. Failure to comply may result in more aggresive legal action.
